Shanks is an excellent swordsman and near equal to Mihawk powerwise. But what if Shanks consumes and masters a DF that makes him so strong, that he can beat Mihawk without using his sword? Would Shanks be able to fairly claim the WSS title?
We might say it is true that everyone is a swordsman that is competent at swordsmanship or even who uses a sword in battle.
But we might also say, that the WSS predominantly includes those whose strongest ability is swordsmanship. Imagine Shanks eats some overpowered fruit like the gravity...

Well, I didn't say Law cannot be considered a swordsman, but replying to Garp the Fist, who said that only Kizaru and Big Mom stand out, saying that Law would stand out even more.
It's not the same. Using Katanas would vastly increase Zoro's attack power. But whether Law swings an old rusty knife or a katana, doesn't matter at all. Because the weapon only draws the trajectory, but the cut happens due to his room.

Maybe Kizaru using a sword against a competent swordsman was the best way to go. At least in base. Who knows what his awakening is capable of. That's called versatility. A swordsman however would always resort to a sword, it's his main fighting style and most of his fighting power comes from it...
That basically makes 99,9% of the OP world swordsmen and the WSS dream the most significant path in the story, since it implies that the greatest swordsman has to surpass all the strongest and most important characters in the series.
And indeed, it's justified to ask why Mihawk never challenged...
