if that's the case, then oda just retconned the dark dark too, because the implication in the moments we saw was that he can only steal fruits from people who died. Newgate and Absalom are dead, Burgess tried to kill luffy. if teach could steal the fruit from luffy alive he would have told burgess to capture luffy not kill him.
