Why not? He’s already fulfilled his role in the story, and Shanks actually killing Kid and crew would actually be positive character development for Shanks and prove that Oda was right when he said that Shanks is scary if you harm his nakama.

There’s also the fact that, if Kid is alive, he’d kinda have to resurface on Elbaf since he sank right off the coast of Elbaf and there’s no other nearby islands for him to wash ashore on.

Countless fake out deaths in the series but somehow without a doubt, kid is the 0.1% exception, yeah okay

To be fair I think Mihawk just can't be arsed fighting them since most of them aren't even swordsmen, and the one that IS a swordsman is someone he's already above (Shanks, obviously)

Kid isn’t even that important anymore though. He fulfilled his role in Wano by being 50% responsible for taking out Big Mom, and is clearly gonna be left in the dust by Luffy. At least Law has being a top 5 most popular character and an extremely hax and useful DF going for him. Kid really has no reason to return to the story, and would probably hurt the story if anything.

Ok, but when are we considering the bet won/lost? Are we gonna wait until the series ends and just assume Kid is dead if he doesn’t return by the end of the series?
