Possibly yes since oda has no other creative method of making characters top tier. But Id rather have him be strong through just crazy observation and something related to the power of love which we know is an actual thing since it’s getting a lot of focus when it comes to feats

He should have it if he is anywhere near Ray/Roger without a DF. If he doesn't have a broken DF and/or ACoC then Gaban is not relative to Ray/Roger.
If he is Sanji parallel then he probably won't have it because Sanji has so far shown zero signs of it. We saw Ray showing CoC in intro and people still were astounded that Zoro got CoC in Wano even though Zoro has shown way more of a conqueror personality than Sanji. Oda could have easily given or hinted towards Sanji having CoC in Wano when Zoro got it but instead we had Usopp and Nami getting those hints/jokes.

Power of Love is funny and all that, but I definitely think Buccaneers transformed their emotions into power, and it would make sense to me if Gaban had Buccaneer blood and Sanji had Buccaneer DNA.
Not only does it seem fitting for Roger to have a descendant of Buccaneer blood in his crew, it would also explain how Gaban could be considered an equal to Rayleigh without CoC - assuming he doesn't have it.
It would offer some explaination how Sanji can kick a laser and turn his "passion" into flames. If the latter was the result of Lunarian DNA splicing, I think we'd know by now.

Doesn't matter, his power level has already been established, he'll prove it with or without COC. But the fandom wont overhype his feats or give him the benefit of the doubt since he's connected to Sanji, so he'll most likely be just as impressive as Rayleigh but not get the same recognition for it, especially if he is somehow restricted by plot. It is what it is.
