Murder and rapes are different things. We need to tackle different material condition to stop them, mainly patriarchy in this case.
I gave you the term "reason" to vulgarize the explanation of material conditions. But "reason" can have a different nature. For exemple, in the case of rape, it's not a "reason", it's a question of "education" and "power relationship". If you takles theses domain in the case of patriarchy, you will prevent rapes.
Murder is a bit different since it's a mix of many things on different context. But you will see that murder are done mainly by men and it's not a glitch, it's a direct result of the impact of patriarchy. So end patriarchy, burn capitalism, but racism or any kind of domination system and you will destroy the condition that pushes people to commit these atrocities.
It's not about telling people to be nice, it's about forging their entire life so they become nice naturally.

It's important to understand that understanding that you make choice, and being able to make different choice are two very different things. If today, I tell you to commit genocide, you will be repulsed by it. But if I'm an Israelian official in Gaza and you are one of my soldier and I tell you to shoot random palestinians, you will have much less reasons to discuss it. Simply because your material condition have changed and you would now be in a position where you have dehumanized palestinians all your life. It would be normal, even heroic, for you to commit such atrocities.
It's the power of material condition, and it's why fascism is so dangerous. Because it destroy our ethics and social limits gradually and very effectively.

It determines what can or can't be communicated with criminal justice.
It depends on many factors. What is the context? Who are the victims? What is the domination relationship between the victim and the perpetuator? What enabled the behavior of the perpetuator? What is the background of the perpetuator? What is the gender of the victim? What is the gender of the perpetuators? Is one agent marginalized? Or not? What is the wealth? Etc.
If we want to create a better system, we gonna need to think beyond "he was mentally ill or deficient". It was already meaningless 50 years ago, it's dangerous now. We need to understand the material conditions and system that shape our behaviors and choices.
