Controversial IP laws hurt artists and fandoms

#1
I am an artist and hence I am more than supportive of artists being justly compensated for their work.

If you create a work of art, I believe you have the right to profit off of it.

The issue I have with IP is that creators/companies don’t simply own tangible work(books, comics, movies etc.) they create, they own concepts and characters.

Imo this doesn’t make that much sense, especially when you’re talking about works that are widely popular, where the original creator has already made their money.

Like take Harry Potter. HP is a massive franchise and JK Rowling has already made boatloads of money off of it.

So why should she or WB or really anyone own the rights to making any derivative work off HP?

It seems like something like that only hurts the fandom. I’m not really that into Harry Potter, but I know it has quite an extensive fanfiction community.

The term fanfiction is kinda looked down upon as juvenile work, but tbh every work created using public domain characters is fanfiction. Marvel’s Thor is a fanfiction using a character from Norse mythology that have existed for thousands of years.

I think fanfic authors should have the write to make money off their work. And if the original creators don’t like it, then they should write better stories.

I think IP just gives corporations an unjust monopoly over works that tbh should belong to the fans.

I think authors deserve compensation for their work, but they don’t deserve to hold on to the characters and concepts of that work and prevent others from creating derivative works.

Using the Harry Potter example. JK Rowling is a literal billionaire. Her fanfic writers are like teenagers. Is it really hurting her if teenagers were able to make a couple dollars here and there selling mediocre fanfic? Probably not.

The only people hurt by IP laws are smaller creators, who are barred from profiting over derivative works and fans, who can only read piss quality fanfic because real professional creators won’t invest in creating art that isn’t profitable.

IP = intellectual property

WB = Warner Bros, a media company that owns tons of IPs
Well if you work for a company then everything you do belong to the company. It is in the contract.

Otherwise you can be autonomous artist and make your own way. Company is offering you visibility since they are well established in their industry.

Sorry but your thread seems like communist cry to me. You get benefit of the environment a big company like WB offers to you but don't want them to benefit for the work you do while they are paying you for it.

You do have a point. It's a very complex issue
