For the sake of tension it would be better if he bit the dust. Stakes should be at an all time high and the story is already reaching its peak, for Oda to pussyfoot deaths and recycle tropes this late in the game would be embarrassing:

I used to want Law to survive but not anymore, I am finally willing to accept his L if it comes. Also I rather he die than Garp.

Garp killed by Teach would advance the story more.

I think it all depends on whether BB wants laws fruit or not. For whatever reason, Moria was kept alive. So he might capture law. If BB doesnt kill law now, I doubt he dies later, since oda gave him a new dream.

And since we know BB wants to be a World Gov recognized king, maybe he will offer to transfer laws fruit to the marines in exchange for a deal.
