So he kld all crew of moria and broke him and now we got to wano and see that he lets everyone survive and and offers them to join his crew. and even if they don't want to, he keeps them in prison to break their will until they give up and join his crew. so why was oda not consistent with this?

Because this manpower is on the table. At the time he was severely set back himself, without the foothold in Wano he now has or an ally in Linlin.

Because this time he's fighting against the main characters, so the plot armor stops Kaido from killing them all.

to break people spirit is Queen's job not Kaido, as we can see in Udon, if those prisoners are not obeying then death pinalty awaits, we almost got Luffy, Hyo, Kid and Killer being killed by Queens game.

I don’t get why Oda couldn’t just kill off Kid’s crew. Aside from Killer they don’t do anything and you could just have more people join his crew after the war

Flashbacks have different logic to them, you must understand this.

Action that takes place without Straw Hats either in the past or the present has almost a 100% chance to be more brutal and radical.
