I think it's the fact that who's who made a mistake (probably had his mind elsewhere and they stole the fruit) instead of Lucci who stayed and fought.

Um Luffy was not a no one. He had already beaten Croc and had amassed a 100 million bounty. That was literally the threshold to get the supernova title and they were known by the marines

Lucci and all of CP9 were going to be imprisoned for failure too. We don’t know what happened to keep them out of it, but Luccis also just a much more valuable asset than whos who.
I imagine it's because Lucci was still their best agent. Even if he failed, no other CP9 agent would've done better anyway, whereas Who's Who failed his mission in a time he and Lucci were still relatively green and unproven.
