Jinbe letting Yamato know you can't just make a claim without the captain's support is telling. Luffy never stated interest in Yamato nor gave the okay of Yamato riding with the crew.

Plus Shogun Kozuki Momonosuke asking for manpower gives an opening for Yamato to join the Wano ranks. This will give a place for Yamato to become a samurai and a place to belong after decades of isolation. It's more likely that Momo will recruit Yamato, not Luffy.
