For a thought experiment, imagine a younger Kaido came to Luffys village, like the one from Kings flashback.. We know he takes in kids(Ulti and page 1) and hears that Luffy has the same dream as his former captain(Rocks in this case). He would also probably help save Luffy from bandits and Luffy would look up to him for adventures and doing whatever he wants.

I think he probably has CoC but if he doesn’t this chapter alone proves his CoA and CoO are really maxed out so it checks out

Can't blame them given how almost all non-DF top-tiers are ACoC users. But these guys are the top of the top tier realm. They'd still qualify as top-tiers even without CoC—they obviously wouldn't be as strong as they are when they have CoC given how big a power up it is.

This belief system mostly stems from Luffy. Peeps just look at the guy and think you can't go higher than that with non-CoC Haki because he has advanced forms when it's proven time and time again that even people with less advanced forms of Haki can have stronger and more refined Haki stats than him.

I think it's clear Gaban is a top-tier whether he has CoC or not, but he must need it or something else that compensates the difference if we're gonna believe he's close to RR.
