There's no proof for Ben having OP observation though and he gave Kizaru an ultimatum which he ignored, the only logical response would be to open fire the second Kizaru goes to attack.

The thing is that there isn't even a guarantee against delays with that. If they push out volume 97, a collection of published materials, I think even combined new material is vulnerable, especially since that would require a huge delay to reformat.
