Simpler answer: Kaido was holding back against Luffy because he wanted Luffy to be Joy Boy.

Complicated answer: the CoC needed to damage the Holy Knights/Gorosei wouldn't be damaging to Luffy/change how Kaido damages Luffy. IE it specifically affects the kind of powers the Gorosei/Holy Knights are using.
