I don't think it's even a formality tbh. CD can do whatever they want unless the Gorosei don't allow it. They can even kidnap the very same royals present at the Reverie if they so much as want that.
Reality vs Formality, I guess. Can the CD´s technically do what they want? Yes, but it doesn´t mean that´s the political system at hand. The CD´s do kidnap even royals sometimes, but when there´s someone the Gorosei want to protect, like Harald, they can´t try kidnapping him. I mean they can talk about it, but we never saw them try. Shamrock meeting with the Gorosei is the same. Should he be showing up during the reverie? On paper, it´s not his time, but he´s special enough that it´s not a big deal.

It´s not like Shanks isn´t a wanted criminal though. Sengoku was shown listening to Koby´s speech and was a bit disturbed at the idea of all the casualties. He isn´t a good guy, but he isn´t supposed to be a complete CD bootlicker really. Shanks is being a good faith actor, so Sengoku is shown respecting that

Anyway, I personally agree Oda was baiting too hard here, but let´s not act like there wasn´t strong implications it could have been someone other than Shanks lol. This isn´t a straight up retcon for sure
