Why not? Especially in that situation, Aokiji didn't use flash freeze because he was merciful, he wasn't worried about Doflamingo, he did whatever would stop Doflamingo the fastest. Akainu doesn't have anything like Kuzan's flash freeze, if he did attack Doflamingo to kill, then Smoker would probably also die. So either Doflamingo checks his ego and hops off Smoker, or there would be 2 dead men that day.
In the grand scheme of things, it was Law who let Doflamingo and Smoker off easily. He had them dancing in the palm of his hands literally

Kaido had zero intention of killing Doflamingo though. Law and Doffy were wrong, Kaido just asked Jack to rescue him
