Kaido said that he got hurt by Snakeman Luffy's attacks so he decided to resort to use FS while being drunk which makes me think that maybe you don't have to be calm in order to use FS. But yeah, both Luffy and Kaido are monsters.

I'm not sure anymore. After rereading the chapter few times I think Kaidou didn't have FS til now. In the chapter, Kaidou says that he'd take a page out of Luffy's book and then disappears. When he appears again, he's in "thieving drunk phase".(I wonder how this would get translated in the Official Translation) Considering the name of the phase and what he said, I think that it's heavily implied that he stole FS from Luffy. Since FS isn't something stealable , my guess is that Kaidou only took the concept of FS and copied it. Hope that Oda would clear this in the next chapter
