Kaido doesn't have FS when he isn't in his drunk form. Read 1037, it blatantly spells it out.
Luffy clashes with drunk kaido, gets knocked back, and notes how kaido's haki is getting stronger

this is why there was absolutely zero mention or indication of FS pre-1042. Because kaido activated it just this chapter by entering into whatever drunk form he used.

So Luffy is fighting a worn down nerf Kaido

Do you think it's really easy to defeat a yonko? even law and kidd win against bigmom is not clear win. oda is making luffy lose again and again because oda wants luffy's haki to increase significantly. Also gorosei is fearing something about luffy. in this chapter Kaido also mentioned strange about luffy df.

It is surprising right that zoan endurance+ oni characteristic have this much endurance...

Also, Luffy worn down Kaido and Kaido worn down Luffy...so it is fine even if Luffy beats worn down Kaido because Kaido full powers will be shown or was shown when the 1 vs 1 started....Luffy not beating fresh Kaido at this point is fine and as it should be....
