So? A hero isn't defined by always doing what you consider morally right. Especially since Luffy freed those criminals in the context of breaking out of Impel Down, get to Marineford and save his brother. And what about him inspiring other people to follow his footsteps? He is a noble kind of pirate, most of his opponents were either evil counter parts or even government officials who truly are evil, all for the sake of other people. Let's look at Naruto's career in comparison.
