I don't think Kizaru was aiming the attack at Shanks, it was at Uta, so technically it's closer to a sneak attack.

Kizaru managed to dodge it, overall the scene isn't a big deal either way. Shanks just intercepted Kizaru, and Kizaru didn't let it escalate.
