The difference is that Shanks has Territories and has a Crew, actually is the opposite that Shanks Bounty who influenced in his Crew, not in the other way.

Luffy had a powerful crew & a Grand Fleet behind him which is how he was made the 5th Emperor by Morgans while Kid and Law who have accomplished MUCH more individually aren't being called the 5th Emperor now even if they have a bounty TWICE the amount Luffy had.
