And what's the problem with that? Luffy is a higher level, Zoro is a YC1+, and Gaban, even though he's a higher level, is old and lacks the same power. If he used his FS to get defeated, there's nothing wrong with giving up. In fact, this makes Luffy and Zoro look bad, because it takes an alliance of both of them to defeat him, haha.
