Look, common law and enforcement of the law are normative concepts that only have meaning by it's coercive nature. So coerciveness (violence) is the foundation of these normative concepts, and that's the reason why Weber defines the state in this way.
So common law and enforcement of the law can't define a state by themselves, because both concepts are not the most fundamental
