To be honest he's "nothing".

Technically he's a pirate by definition of the word Shichibukai, but where is his jolly roger, his crew or his ship? He's a carefree criminal regardless of brand.

Luffy was a pirate before having a crew or a Jolly Roger. Not sure where this idea that you need a Jolly Roger to be a pirate comes from.
