Therefore yes Mihawk can use “Divine Departure” and habetter sword skills in his bag.
I repeat : Shanks is a genius to have been able to mimic Roger’s sword skill and Mihawk have better sword skills than Shanks.

Yes, it means Shanks'/Roger's signature move was available to him when he fought Mihawk, so the only difference between pre Yonko and Yonko Shanks would be ACoC, but we know ACoC is an amplifier used by swordsmen too, as Zoro himself did it. And if Mihawk considered Shanks a rival in swordsmanship, Zoro will also consider Shanks an obstacle in the pursuit of becoming the WSS.
Now Roger wasn't called the WSS, but that's probably because his title as great pirate and PK was more relevant, and the WSS title was more of a thing as the great era of piracy started and people set sail to conquer.

If Roger was alive, Mihawk still would be WGS, so Shanks who uses same style as Roger > Mihawk as well.

When the manga compares Mihawk sword skill to Shanks sword skill it is comparing a fighting strength, not that fighting style. Mihawk's bounty is based on his strength and power.
