Luffy has no reason at all to be on pirate king race. He just wants to be the most free man on the world and he thinks Pirate King is that guy. So he is a slave. He can't feel free until he becomes Pirate King.

In volume 1, we can see that Luffy still wanted to be a pirate BEFORE eating the Gum Gum. That's where he got the scar.
We could even take into account non canon stuff like romance dawn but I don't think it's pertinent.
