1. It is not obvious based on current story
2. Last time I checked, Sulong Bepo even save Law and escape with him
:lawbepo:
We can theorize, but saying that Law was obviously captured is a stretch until we get more panel.
Nappa were toying with much, much more modern human weapon than the one that available in One Piece bar Ancient Weapon.
And Saiyan Saga Vegeta was casually a planet buster:
They barely pass Nappa and stop at Vegeta.

True, because postpone is better than surrender.
With postponing the fight, at least the result still could be debated.
But with surrender, you basically leaving the fate to those who you are surrendered. Clearly an inferior choice compared to postpone.

There are plenty of another options aside of FS.
One of the most probable reason is he just using simple COO and gauge both Luffy's and Zoro's power level and their seriousness in fighting him.
He might very well can hold his own more than 10s, but he knew he cant beat both Luffy and Zoro if...
Could be plot, but before the chapter are out, we have alternative

Either this or those regen could only be obtained by those who were summoned via 'Abyss' (or can only be assigned temporarily for those who are in certain mission).
If someone is powerful enough (or has enough haki) to beat those who were summoned, those who were summoned will disappear and...
The main topic is Oden was about to beat him fair and square while both were fighting at the same age.
The 5 silhouette that was showed are characters that Kaido rate at very least on par with him or even above him, not just on par with him.
And he was wondering if Luffy could reach that level...
Agree with the rest, but this one is debatable.
Even if he's not in his prime, the same benefit of doubt could also be given to Oden which has same age as Kaido.
If you said that Kaido isn't in his prime, you should also consider that Oden isn't in his prime too and he 'technically' beat Kaido...
