Does it count if kizaru as being down for the past 3 minutes and luffy could have finished him in that time span but could not because of the gorosei.

Or would kizaru have defended himself if luffy choose to attack him

Why not?
Luffy was down multiple times and we called that a defeat for Luffy and a Win for Kaido
Kaido could've finished him for good he said it himself ( before the 4th loss )

Luffy won because he one shot kizaru.. twice. I mean Luffy was kicked through the labophase and almost died and yet Kizaru still gave Luffy almost no difficulty. Luffy seemed to have the upperhand in g4 and literally toyed with Kizaru in g5.

Difficulties aside Kizaru is not a threat to Luffy anymore.

And that attack did zero damage on Kizalu. Kizalu still looks clean, and has been doing that same pose for quite a few chapter now. Luffy hasn't been much of a factor in Kizalu's ordeal.

Luffy while using G5 attacks has not managed to damage Kizaru. There is absolutely no lasting damage. The only reason Kizaru remains down is because his biggest fight is with himself, he was shown heavily panting and sweating after he pierced Vegapunk usually a sign of someone being under heavy mental and emotional stress and then he covered his eyes on the ship.

Nothing about this is related to Luffy lol. He factually has yet to damage anyone.

Just like you said when he got hit with WSG and we see him admitting he can't move for the time being

If he wasn't damaged nor unable to move, he'll stand up straight like he usually does
