Cap actually. The highest force in the marines that is not government affiliated is the fleet admiral. Rules regulations responsibilities etc starts at the top which is why if was emphasized that the marine forced change when akainu becamse fleet admiral so that's cap.

When those two (Law and Kidd) saw what Luffy did on his own that they had to do as a duo they should have just raised the strawhat banner and joined the fleet and/or crew.
