Not quite. A lot of the amendmens were initially made vague to be open to interpretation for later societies. It's the main reason the 2nd Amendment and gun control is such a debated topic. The 1st Amendment is one fo the few that's set in stone, but they even find loopholes around that one.

A good way to understand and confirm what I have been saying here is by observing who is defending Musk in medias and internet.
And one of these groups are people who kept on trying to legitimize the genocide of Gaza and call antisemitic every studient protest. This is a clear case of two far right groups finding a common interest.
For example we have a guy in France who calls himself a leftist who has been constantly attacking the left on the principle that they are creating antisemitic dog whistle (the antifascist red triangle being one of them) and after Musk's gesture he said this:
"It's not a nazi salute, but the awkward gesture of a guy who sends hearts to a mob of fans. Even when the danger is in front of you, you keep fighting windmills"
This is not a surprise that the defensors of fascist methods are now defending a fascist gesture.
