But if you are inside the bubble of warlords then you are a pirate, that's the thing. It's a group made of pirates whose piracy is sanctioned, not a group of independant sailors.
"Looting" as definition of being a pirate seems quite simplistic in this particular context too, considering that in One Piece pirates may not even loot but simply live their lifes as free men, establish a huge empire that works like a country, and so on. We don't know if he has a Jolly Roger nor whether a Jolly Roger is actually obligatory for a pirate to be such, which would feel a bit forced. I doubt there's such "being a pirate" concept in this story, and if there is, it's probably more related to doing whatever you want because a pirate is free.

I know that. But Kaido is the only character the manga tells us can't be hurt. That's why nobody, not even Kaido himself. Which has never made any sense. He was supposed to be in battles against the Marines and other strong opponents yet nobody could hurt him except a handful of people who are mostly commander and veteran level.
We don't have to scale EoS ambitions. Zoro bowing down to hawk eyes strikes me as their fight not being all too important anymore, and could be handled in an epilogue or something. He doesn't necessarily have to surpass Mihawk EoS, just beat whoever the #2 to the final villain is.
Killer fought both Kaido and Shanks. He didn't call Kaido just "one of the strongest" and he never called Shanks "the strongest". I don't understand how people think all emperor's are equal in individual strength. Clashing doesn't mean two people are equal. Shanks has no reputation of being particularly strong individually among his yonko peers.
WB is clearly renowned as the strongest or very close to the strongest in the OP world by everyone. Renown doesn't go away with old age. So Mihawk trying to measure him strikes me as him just being curious and suspecting the difference between them is smaller than the hype. Mihawk and WB probably have never actually interacted before in the same way Shanks and WB seemed to be acquaintances or even friends. Mihawk's wording in that translation is just that: conjecture. The entire point of that scene was to hype up WB. "Is he as strong as everyone thinks he is?" Which is promptly answered in the form of one of his followers blocking Mihawk's slash.
Shanks and BB don't necessarily have to be as strong as Kaido/BM who have been portrayed as close. We don't go around explaining all of the clashes in Wano, where the stakes are high, as denoting equality between characters, do we? Plenty of room to fit other characters in-between Kaido/BM and Shanks.
I suspect it probably goes something like Kaido>=BM>Akainu>Mihawk>=Shanks. I think it's pretty irrefutable that Mihawk scales to Shanks. Wherever you put Shanks, you must put the hawk eyes. Akainu also gets a lot of special and unique hype from Oda.
The other two admirals strike me as being above Blackbeard, who's still a relative rookie as of this time. Kuzan was near-equal to Akainu to the extent that only a 10-day fight brought forth a result. His injury may set him back and Akainu may be getting stronger, but we can't underestimate them.

Mihawk is a pirate. The Shichibukai were introduced as 7 pirates that lend their power to the WG. And yes, they are still pirates while Shichibukai, they don't lose that status. Hence Doflamingo told the CP0 guy that he, even though he is a Shichibuai, is still a pirate who is free to do as he wishes. And why did the Marines start chasing Mihawk after his Shichibukai title was taken away? What is he, if not a pirate? Is he a bandit?
