i think oda only came up with the non touching thing during the oden flashbacks

In the same chapter , black lightning appears when Luffy and Kaido use acoc haki , but it is not there when Zoro uses Ashura.

You can be excused for one round bcs everyone loses that to Kaido but if you dont win in second round, say goodbye to top tier.

If we count Yamato as one round of Luffy, which is pretty fair considering she did better than 1010-1013 Luffy, this is 3rd round he lost with ACoC, not even counting the two previous ones without it...
