The rank of commander is worthless amongst the Top Tiers. But that doesn't mean someone can't be Top Tier if they're a commander. Aokiji is the clear counterexample.
It's like Vice-Admiral rank. It means nothing amongst the heavy-weights. But there are some super strong Vice Admirals.

Law and Kid and Luffy genuinely were pretty close in power post timeskip imo. Law and Kid as dead equals and Luffy as just barely stronger (genuinely I think law would win 1v1 since Luffy sucks against smart fighters)

All of those characters have other more important titles that portray them as top tiers. Is that not clear enough they are not commanders.
