I do think Mihawk is an solid Top Tier, not one of the strongest in verse, but a regular top tier.

He has an solid portrayal which distinguish him and makes him an anomaly between Admirals and Emperors

He is the key for Zoro enters in the top tier league.

He surely has an incredible AP and strong Haki, i bet he's greatest atribute is CoA.

Even if he has a fruit in his sword that's not enough since Issho and Law have fruits and yet they're still swordsmen
Same for Kaku and Nusjuro
If he drops the sword completely in the future and has another fighting style on top of that then yeah he might not be a pure swordsman but so far we can't just assume he's not a swordsman right now

But again this is fine since Shanks' character doesn't revolve around his raw strength, he's not that type of guy at all. If it were someone like Kaido, Whitebeard or Mihawk and they were confirmed to be below certain people then that'd be horrible for them since a lot of their hype builds off being the strongest and what not
