It was really strange Oda made Kaido take King sword to behead Orochi and that is to recall the legend aka to kill an Hydra Orochi beheading it does almost nothing (when smashing it with a club is not contemplated in mythology lol) so Orochi is most likely still aluve even because we got to see nothing about his df.
Well Orochi has been seen using his df only once so far, during the party at his palace and while talking with the CP0 . It will not be the last.
 
Oda doesn't like killing villains, and it's not because he is 100 percent opposed to killing. But it's because he believes they should have their dreams crushed and live with that knowledge. For some it is a fate far worse than death.

But even if Oda does decide to break that mold (I know that was how he felt years ago, not sure if he still does), killing Orochi here doesn't make a whole lot of sense. He'll never have to face the Scabbards for what he did. He'll never be confronted, nor have to own up to what he did. Dying now, is the easy way out. Toki's prophecy amounts to nothing. Straight D&D from Game of Thrones fuckery, in all honesty.

Indeed, Oda will never waste a myth df based on a japanese myth with just a scene where he trashes a little. At worst, unlikely, Kaido somewhat come to know BB method of stealing dfs and stealed it to give to Yamato or something but yet this would be weird and Orochi has still a role to fill even if without an army and subordinates bar maybe the ninjas if they stay loyal. Anyway he is gonna get what he feed to Oden aka betrayal.

Remember there was no blood like this case, also remember it was clone unless you think that Orochi that Kaido beheaded was also a clone which was not clearly because clones won't spill blood....only thing that could help Orochi is his DF

Doffy punishment came from Luffy instead of Rebecca Kyros Law
Literally, Luffy has been beating people that were supposed to be beaten or killed by the people he (the villain) wronged the most
