The only thing that matters with the Kaido SBS is if Oda includes anything of the form of "he is known as", "said to be" or "people say".
That's the source of almost all the doubt about Kaido's "title".
If he definitively says "Kaido is the World's Strongest Creature", then his top 1. Otherwise, he most likely isn't.
I guess we have to wait for Viz to answer this question.

Killer made a clear and direct statement of who the WSP was. He did not use the word known or anything like that to raise doubts. As long as Mihawk is a pirate, he will be below KAIDO. "Our enemy is the strongest pirate in the world!" How do you respond to that?

When you will realize that I'm not fan of anyone, I'm just enjoying the story as long as it delivers good writing with classical literature rules. Back in pre-timskip I thought one piece was good but post-timskip showed Oda's true colors.

Kaido was called the world's strongest creature after WB died. He's still a man. Oda called him the World's strongest man in the latest SBS and not any 'creature'. Old WB > Kaido, not by feats but by what Oda has told us.
