Everything was hypothetical. It was all set up for an "in case shit happens" scenario.

They kept getting investigated, but nothing came about it.

Eliminating York would have done nothing but prove her accusations to the World Government.

So until they were caught dead to rights, they weren't pulling the trigger on anything.

There are several problems with that though:

1) This plan completely fails anyway if the WG simply decide to capture him and imprison him in Impel Down, while looting all the important stuff from Egghead and doing business with York.

2) Having said this, Vegapunk was absolutely sure they will kill him - so why on earth actually sit it out with an insanely risky plan in case the 0.01% chance of the WG not arriving happens? If they indeed don't come all he just did was erasing their knowledge about York's shady business with the WG and she can continue doing so. Heck, even now the WG aquired the Mother Flame and someone to use and reproduce it (York) due to Vegapunk's "plan". It's just a stupid process from start to finish.

There is zero advantage compared to simply eliminating York on the spot, making sure Mother Flame can't be used anymore, sending out the message immediately and then dipping and hoping for the best.
